These Terms of Service (“Terms”) govern your purchase of and access to Ambitious Investing’s website, course platform, member community, live calls, coaching, educational resources, events and related services (together, the “Platform”). Ambitious Investing (“we”, “us” or the “Company”) is based in New Zealand and operates with members in New Zealand and Australia.
1. Agreement and acceptance
These Terms apply to any Ambitious Investing program, membership, course, coaching, community, event, member-only service or related access you purchase or use. By ticking the “I agree” box at checkout, signing an onboarding contract, making a payment, creating an account, logging in, or accessing the Platform, you confirm that you have read, understood and agreed to these Terms. Each of those actions is legally binding as if physically signed.
Your individual enrolment or onboarding contract controls the specific commercial terms of your purchase, including price, access period and payment schedule. These Terms sit beside that contract and protect the Platform, community, members, mentors, staff, educational resources and intellectual property.
2. Program delivery and service rendered
Upon full or partial payment, we provide the digital services and access included in your purchase. This may include educational content, digital materials, authorised community spaces, live sessions, calls, coaching, market analysis, recordings and support, depending on what you purchased. Schedules, topics, levels, calls and member features may change.
Digital services are delivered immediately when access is granted or made available. Access to any course material, community, live session, call, coaching or other purchased content is the moment the relevant service is rendered. Delivery of access, materials or services constitutes fulfilment of our obligations for that delivered portion.
3. Non-refundable agreement and cancellation
All payments are final and non-refundable once access to any part of your purchase has been granted. You are purchasing educational services, not a financial product or investment opportunity. Dissatisfaction, change of mind, non-usage, lack of results, cancellation of access, or removal from the Platform does not entitle you to a refund or chargeback. You may stop using the Platform or ask us to remove access, but this does not cancel any amount owed under these Terms or your onboarding contract.
Nothing in this clause limits non-excludable rights under the Australian Consumer Law (ACL) or the New Zealand Consumer Guarantees Act 1993 (CGA). To the maximum extent permitted by law, our liability is limited to the resupply of services.
4. Payment plans, failed payments and debt collection
The full price shown at checkout or in your signed onboarding contract is owed. A payment plan or instalments are a payment convenience only, not a cancellable subscription. You authorise automatic charges to your nominated payment method for scheduled payments and remain legally obligated to pay the full agreed amount regardless of participation, use or results. If a payment is missed or fails, we may retry it, suspend or terminate access, and the unpaid balance remains due.
Missed or failed payments may incur reprocessing fees. Overdue balances accrue interest at 10% per annum, calculated daily until paid in full. We may refer unpaid balances to a licensed debt-collection agency and, where permitted by law, share relevant information with credit-reporting bodies. Collection fees, interest, recovery costs and legal expenses may be added to your outstanding balance.
5. Chargebacks and payment disputes
You agree not to initiate a chargeback, reversal or payment dispute with your bank, card issuer or payment provider. If one is initiated, you agree that we may provide the card issuer, payment provider, financial institution, debt collector or court with your checkout acceptance, these Terms, your signed onboarding contract, payment records and Platform access logs as evidence of your contractual obligation and the digital services delivered. You remain liable for all recovery, collection and legal costs incurred as a result.
6. Member conduct
You must engage with members, mentors, staff and representatives with reasonable respect across all authorised platforms, communities, educational environments, live calls, events and member interactions. You must not harass, bully, intimidate, threaten, discriminate, abuse, degrade, repeatedly personally attack, deliberately disrupt, or engage in unsafe or seriously inappropriate conduct.
Respectful disagreement, criticism, feedback and genuine complaints are not misconduct. We may suspend or remove access for serious misconduct, non-payment, breach of these Terms, or breach of community guidelines. Removal is without refund and does not release you from payment obligations.
7. Community integrity and external groups
“Authorised Platforms” means the official websites, apps, community spaces, calls, events and channels we approve for member access. “Ambitious Content” means our educational materials, recordings, frameworks, resources, member discussions, brand assets and intellectual property. An “Unauthorised Community” is any unofficial Discord, Telegram, WhatsApp, Facebook or similar group made mostly of Ambitious Investing members to discuss, share, teach or apply Ambitious Content without written permission.
You must not impersonate us, claim to represent us, falsely suggest external activity is endorsed by us, interfere with Platform services, exploit the member network, or use our name, brand, reputation, community or member base to create or promote an Unauthorised Community.
8. Account access and sharing
You are responsible for your login credentials and all activity under your account. Do not copy, reproduce, record, distribute, resell or share materials, recordings, access or login details without our written consent. Any sharing exception expressly included in the access you purchased is limited to immediate household family members who live under the same roof. Sharing with friends, acquaintances, extended family or household family members living elsewhere is not permitted.
9. Educational information, no financial advice and no guarantee
All information provided through the Platform is educational and general information only. It is not financial, trading, investment, tax or legal advice. We and our representatives are not licensed financial advisers. Nothing provided takes account of your objectives, financial situation or needs. You accept sole responsibility for your trading and investment decisions and outcomes. Past performance is not indicative of future results, and investing and trading involve risk of loss. No guarantee of success, income, return or trading performance is made or implied.
10. Intellectual property and indemnity
All materials, recordings, resources, brand assets and educational content are proprietary to the Company or its licensors. Unauthorised use may result in immediate removal and legal action. You agree to indemnify and hold harmless the Company, its directors, employees, contractors and representatives from losses, liabilities, claims or expenses arising from your actions, participation or breach of these Terms.
11. Limitation of liability
To the maximum extent permitted by law, we are not liable for any loss, damage or claim, including financial, trading, consequential or indirect loss, arising from your participation or reliance on Platform content. Any liability is limited to the resupply of equivalent services.
12. Dispute resolution
Before commencing legal or regulatory action, you must send written notice of the dispute to info@ambitiousinvesting.com.au and allow at least 14 days for a good-faith resolution. If the dispute is not resolved, both parties agree to participate in mediation in Auckland, New Zealand, or another location we agree in writing. Only after mediation may either party commence court proceedings, except where urgent injunctive relief is required.
13. Governing law
These Terms are governed by the laws of New Zealand for New Zealand residents, and by the applicable laws of Australia for Australian residents, including any non-excludable rights under the ACL. Each party submits to the jurisdiction of the applicable courts.
14. Entire agreement and changes
These Terms and your signed onboarding contract constitute the entire agreement relating to your purchase and supersede prior discussions or representations. If there is any inconsistency, the program-specific signed onboarding contract applies to that extent. We may update these Terms as the Platform changes. The updated date above shows when they were last revised, and continued access or use after an update is acceptance of the revised Terms.
